What a Notary Public Does
A Notary Public is a state-commissioned official whose role is to help deter fraud. A notary’s job is primarily to verify identity and properly complete the notarial certificate required for your document.

In plain terms, a notary typically:

● Verifies the signer’s identity using acceptable identification (or other lawful methods when applicable)

● Confirms the signer appears to be signing willingly and is aware of what they are signing

● Completes the correct notarial certificate (such as an acknowledgment or jurat)

● Administers an oath or affirmation when a jurat is required

● Makes the required journal entry for the notarization

Acknowledgment vs. Jurat

Type What it Means Common Use
Acknowledgment The signer confirms the signature is theirs and that they signed voluntarily. Deeds, powers of attorney, and many business documents
Jurat The signer signs in the notary’s presence and swears/affirms that the contents are true. Affidavits, sworn statements, declarations

Personal appearance: Notarization requires the signer to appear before the notary at the time of notarization.


What a Notary Cannot Do
Notaries have strict legal limits. A notary public:

✖ Cannot provide legal advice, interpret documents, or tell you what you should sign

✖ Cannot choose your notarization type as a legal decision (acknowledgment vs. jurat)

✖ Cannot notarize without the signer present

✖ Cannot notarize incomplete documents (missing pages or required information)

✖ Cannot backdate or falsify a notarial certificate

✖ Cannot represent you in court or act as your legal representative

Notary Public vs. Notario (Very Important)
In many countries, a Notario Público (sometimes called “Notario”) is a highly trained legal professional who may draft legal documents and provide legal guidance.

In California, a Notary Public is not an attorney and has a limited, specific role focused on identity verification and completing notarial certificates.
